Private app terms of use
Draft for Society review · Revised 15 October 2026 · Effective date pending
Unverified details are explicitly marked. This draft has not been confirmed as the live service’s adopted policy.
Provider and scope
The private Phoenix Theatre Clover Integration is provided by David Johnstone (Developer), who develops and maintains it on behalf of Phoenix Theatre Management Society (Society). These terms govern the Society’s and its authorized personnel’s use of the integration. They do not replace customer ticket-purchase terms or separate agreements with Clover.
Permission and authorized use
To the extent the Developer has authority to grant it, the Society and its authorized personnel receive limited, non-exclusive, non-transferable permission to use the app for the Society’s internal theatre operations. This does not transfer software ownership or change applicable third-party licences or a separate written agreement.
Users must have the Society’s permission and authority to connect its Clover merchant account, protect their credentials, and report suspected unauthorized access. Users must not bypass controls, access another merchant’s records, or use the app unlawfully.
Current functions and payment status
The app currently supports authorization, merchant validation, device listing, and connection testing. Terminal sale and ticket-refund processing is implemented behind disabled activation controls and remains subject to physical-device validation and applicable approvals. A successful connection test is not a payment confirmation. Tickets are issued only after verified payment success; uncertain payments or refunds are retained for reconciliation and may require manager investigation. These terms and the privacy policy must accurately describe the enabled functions before activation.
Customer records and privacy
The Society is responsible for customer records and decisions about collection, use, disclosure, retention, and privacy requests. The Developer processes information on the Society’s behalf for authorized technical and support purposes, without permission for independent marketing or unrelated use.
The Phoenix Theatre Ticketing and Clover Integration Privacy Policy describes cookies, external images, enabled providers, storage findings, unverified hosting details, and retention controls. Account disconnection or deletion does not automatically erase required financial records, provider records, or protected recovery copies. The retention schedule is subject to legal holds and unresolved operational cases.
Clover and other services
Clover supplies its own platform, devices, and payment services under separate agreements. Clover and its affiliates are not parties to these terms, are not the provider or licensor of this app, and assume no obligations or liability under these terms. Users must comply with their applicable Clover agreements. Other providers’ services remain governed by their respective agreements.
Availability, support, and suspension
Availability depends on the website, internet connectivity, hosting, Clover services, device availability, and valid authorization. Interruptions, maintenance, and reauthorization may occur. Users must review results and report unexpected behaviour; uncertain financial outcomes must be investigated before another charge is attempted.
Contact president@phoenixtheatre.ca or +1 250-774-2241 for app support. Telephone support hours are Monday–Friday, 1:00–4:00 p.m. MST (UTC−7). Access may be suspended to address unauthorized use, security, maintenance, or provider requirements. The Society may request disconnection. Required records and holds remain subject to the privacy and retention procedures.
Changes and separate agreements
Material changes will be communicated to the Society and published with an updated revision date. Separate written agreements concerning fees, intellectual property, support, or termination remain applicable. The effective date must be confirmed before publication.
